A Message From Steve Howard For Victims of Injury

If you have been injured and are now considering what legal rights may be available to you, you should be aware of the following:
1)  The most important goal of an insurance adjustor is to protect the financial interest of the insurance company, not your financial interest.

2)  The insurance adjustor’s greatest wish is to deal with the unrepresented victim of injury.  The typical insurance adjustor has been well trained to keep the settlement as low as possible, and knows the rules and procedures for recovery.  The typical victim of injury does not understand what their claim may be worth.  Victims of injury who attempt to represent themselves are getting into a completely unfair fight.

3)  If you are asked by an insurance adjustor to give a statement concerning the facts of your injury and damages, expect that your statement, especially if given by telephone, will be recorded and can be used in evidence at a later trial.

4)  If you have been injured, get the medical care you need as soon as possible.  Your recovery to good health is of the utmost importance.  Your body will heal sooner if you receive timely medical care and the facts of your injury will be appropriately documented.

5)  If you are involved in a vehicular collision, take pictures, lots of pictures.  For example, you should take pictures of your injuries, the vehicles and the scene of the collision. Photographs of the marks on the road and the bruising on your body are, in the words of the old saying, worth a thousand words.

6)  If you are the victim of any injury, immediately begin to keep a journal or diary of your medical treatment and recovery.  It will be invaluable if you should be deposed at a later time.

7)  There are strict time limitations for the prosecution of your claim.  If ignored, these statutes of limitation can bar you from making a recovery.  Don’t let the clock run out on your claim.

8)  This office typically represents clients through a contingency fee agreement in the recovery of damages for personal injuries. No attorney’s fees unless you recover. Court costs, litigation expenses, and medical bills are paid from your share of the recovery.  If there is no recovery, you will not be responsible for any court costs or litigation expenses, except for unpaid medical bills.

9)  The experience, courtroom abilities and reputation for integrity of the lawyer you choose to represent you does matter, both for your peace of mind and in the amount of your recovery.
Before speaking to an insurance adjuster, seek the professional guidance of a lawyer who knows how to deal with insurance companies.
